Waving a gun around in a public place makes people nervous and if bystanders cant tell the difference then for the purposes of the charge you were brandishing a weapon.
To be fair that water gun does indeed look like a real gun.
To be fair, it’s not illegal to be in possession of a water gun that looks like a real gun.
