  • Spain’s 2015 Aliens Act had a special rule for Ceuta and Melilla allowing immediate handover to Morocco.

    On 29 June the Supreme Court ruled (STS 814/2026) that someone swimming around the fence hasn’t climbed anything, so the fast-track rule doesn’t cover them. They get the ordinary return procedure instead: identified, lawyer, chance for asylum.

    True, Ceuta doesn’t get you to Spain. The point isn’t instant onward travel, it’s that Ceuta converts you from someone with no legal standing into someone inside a process. Unaccompanied minors can’t be deported at all (they fall under child protection law)

    When the enclave overflows, Spain has historically moved people across simply for lack of space.

    And time on Spanish soil starts counting toward arraigo (regularisation after two years of continuous residence).
