      Yep, tips can credit towards minimum wage.
      Depends on state, but it means the employer may go as low as $2.13/h if the employee gets enough tips.

      So, you might just be tipping the employer.

        Jesus that’s extremely illegal in most western countries. Minimum wage is minimum wage, you’re not allowed to include theoretical tips that the server might get.

        It’s the same with performance bonuses, which is essentially what tips are, the base salary has to be declared on the job listing and has to be paid. None of this “with gratuity salary is equivalent to minimum wage” nonsense.

      I mean there’s always the chance, but it was a local place and I’d like to imagine a mom and pop wouldn’t do an employee that shitty
